Closed Prize Draw Terms and Conditions

1. By entering this prize draw, you agree to be bound by these terms and conditions.

2. To enter this prize draw, you must be a UK resident and aged 18 years or over. This prize draw is not open to employees of Comic Relief, their close relatives, or anyone connected with the prize draw. Proof of age, identity and eligibility may be requested.

3. Entry will be based on completing the Red Nose Day 2024 registration process, confirmation of which will be sent out by email from fundraising@comicrelief.com. An option to opt in to the competition will be provided on the registration web page. Only one entry per person is allowed. If more than one entry is received only the last entry submitted will be eligible.

4. There is only one prize to be won. The prize will be a surprise from one of our celebrity friends to support your fundraising. The winner of the prize draw will be announced on/by Friday 15 December 2023.

5. For the avoidance of doubt, unless specified above or otherwise agreed in writing, no other costs or expenses will be covered by Comic Relief.

6. The prize draw commences at 9:00 on Monday 4 September and is open to all who complete the Red Nose Day 2024 registration process before 23:59 on Thursday 14 December 2023, and who submit a valid email address. 

7. The winner will be selected by random draw on Friday 15 December 2023 and Comic Relief will contact them by email to notify them of their win as soon as is reasonably practicable after this date. If the winner does not answer their e-mail after 48 hours, Comic Relief will contact the next eligible winner. Comic Relief’s announcement as to who the winner is, is final. No correspondence relating to the prize draw will be entered into.

8. Comic Relief must publish that a valid award took place. To comply with this requirement, Comic Relief will publish the surname and county of the winner and, if applicable, their winning entry on comicrelief.com on Monday 18 December. If you object to any or all of your surname, county and winning entry being published or made available, please contact Comic Relief by emailing us.

For the avoidance of doubt, Comic Relief must still provide the information and winning entry to the Advertising Standards Authority on their request.

9. Prizes will be as stated. There is no cash alternative and the prizes cannot be sold or transferred for value in any circumstances. If a winner wishes to give the prize to another person as a gift, express prior consent must be obtained from Comic Relief.

10. The prize is subject to change. Descriptions of the prize are provided without a warranty of any kind. In no event shall Comic Relief be liable for any claim demand or damages caused to an entrant by reason of a description of the prize being inaccurate, incomplete, or for the prize being otherwise in any way different to the entrant’s expectations. Comic Relief reserves the right to disqualify any entries that breach these rules or are in any way fraudulent. Comic Relief reserves the right to cancel the prize draw at any stage, if deemed necessary in its opinion, or if circumstances arise outside its control.

11. Failure to claim the prize by the time or in the manner specified by Comic Relief will make any claim invalid.

12. The winner agrees to take part in any reasonable post-prize publicity with Comic Relief if required. Comic Relief reserves the right to use the name and approximate location of the winner. Including their photograph or video content, for promotional and publicity purposes.

13. Comic Relief may amend these terms and conditions from time to time, and will make such changes by amending them on the Comic Relief website.

14. Comic Relief does not accept any responsibility for any network congestion, technical failure or other problem in any telephone line, network, system, provider or otherwise which results in any communication not being properly recorded or received.

15. To the extent permitted by law, Comic Relief exclude all warranties and representations (whether express or implied), and all its liability (including without limitation for negligence) regarding this competition or the prizes (other than for death or personal injury resulting from its negligence) including without limitation all indirect or consequential loss or damages, loss of profit, or loss or damage to data.

16. Our lawful basis for processing your personal data is that it is in our legitimate interests (and we don’t believe this unreasonably impacts on your rights or freedoms). 17. These terms and conditions are governed by the laws of England and Wales.

1. The prize draw will open on 10 March 2023 at 10:00am and close on 19 March 2023 at 23:59 for entries via text and on 22 March 2023 for entries via post.

2. Entry to the prize draw is either:

  • a) by texting the keyword SONG to short code 81155. Text messages will cost your standard network message charge (based on your service provider rates – please check with your provider). You will then receive a free bounce-back message from 62345 informing you that a voluntary donation of £10 to Comic Relief will be taken 60 minutes after the entry text was received, unless you reply to 62345 with the word CANCEL before 60 minutes has passed. If you don’t respond CANCEL to 62345 within those 60 minutes, you will then receive a text from 70210 confirming your donation and asking you if you’d like to make a Gift Aid declaration; or

  • b) via post – each postal entry should be submitted within an envelope, or on a postcard, write your first name and surname, full address (no PO Box addresses will be accepted), contact telephone number (including area code if providing a landline number) and the title of the prize draw promotion you are submitting an entry for, which can be found at the top of the terms and conditions, for example, “Liverpool Calling Free Prize Draw”. Entries received on anything other than a standard postcard or envelope will not be accepted. 3. For the avoidance of doubt, if you enter via text, opting out of the voluntary donation will not affect your entry into the prize draw and all entries (including postal entries) will be treated in the same way for the purposes of the prize draw.

4. The prize draw is open to all residents of the UK, Channel Islands and Isle of Man, aged 18 or over, except staff members of Comic Relief (the organisation behind Red Nose Day), of BBC Group, of any of the prize providers, and their close relatives, or anyone connected with the prize draw. Proof of age, identity and eligibility may be requested.

5. If you enter via text, you must have the billpayer’s permission to enter. Please ensure you spell the keyword correctly and send your text message to the correct short code, however, if Comic Relief, acting reasonably believe you are trying to enter, Comic Relief will still accept the entry even if you entered the keyword incorrectly. Alternatively, Comic Relief may instead send you a message to let you know that your entry has failed. The message Comic Relief send to you in this instance is not a confirmation message so, whilst you will be charged your standard network message charge, you will not be entered into the prize draw promotion and will not be donating to Comic Relief. If your text message is received outside the times and dates specified for the prize draw, you will not receive a bounce-back message but may still be charged your standard network message charge. You will not be donating to Comic Relief nor will you have entered the prize draw. You will not have been added to any marketing databases if Comic Relief send you a follow up text unless you have expressly requested to be.

6. If you enter via post, please ensure that all the information required is included in the entry and that it is clearly written. Your entry may be deemed invalid if it is not readable. If your postal entry is received outside the times and dates specified for the prize draw, your entry will not be accepted.

7. You may enter the prize draw via text a maximum of four times a day (midnight to midnight UK time). You will receive a free bounce-back message regarding the donation each time, and if you wish to opt out of the donation you need to respond to each such message received from 62345 by texting the word CANCEL to 62345. If you try to enter into the prize draw more than four times a day, you will still be charged your standard network rate but will not be charged any donation to Comic Relief and the additional entries will not be accepted. Also note that pre-paid customers who are trying to enter more than once (e.g. donate £20 or £30) but have insufficient credit, may only be charged £10 or £20 (as applicable).

8. If you are entering the prize draw via post, you may send a maximum of four entries per day. A maximum of one entry can be made per envelope or postcard received. If you send more than four entries per day or more than one entry per postcard or envelope, the additional entries will not be accepted.

9. There is only ONE prize available to be won:

  • 2 x top tier seated tickets, priced at £380 each, to the Eurovision Song Contest 2023 Grand Final in Liverpool on Saturday 13 May 2023.

  • Up to £500 of your associated travel costs. Travel must be from UK, Channel Islands or Isle of Man.

  • Accommodation for two in Liverpool, for the night of 13 May 2023.

  • A meet and greet for two with Scott Mills and Rylan Clark on 13 May 2023.

10. The winner will be selected using an independent randomised draw system on 27 March 2023 and contacted to notify them of their win. Comic Relief will attempt to contact the winner between 09:00 and 19:00 that day by phone. If the winner does not answer after Comic Relief’s reasonable attempts to contact them (meaning 4 calls per day at various times of the day over two days) Comic Relief will move on to contact the next randomly selected entrant.

11. For the avoidance of doubt, unless specified elsewhere in these terms and conditions or otherwise agreed in writing, the winner is responsible for all arrangements and costs required to access the prize including but not limited to, travel, accommodation and food and beverage costs, and no other costs or expenses will be covered by Comic Relief, the BBC, or any of the prize providers.

12. Any accessibility or dietary requirements for the winner or their guests need to be disclosed to Comic Relief within two weeks from notification of the win. The winner and their guest may need to adhere to Health & Safety and security requirements imposed by Comic Relief, the BBC or any venue(s) associated with the prize. The winner is responsible for ensuring they are able to accept the prize as set out in and in accordance with these terms and conditions. Neither Comic Relief or the BBC will be responsible if a winner is unable to make use of the prize by reason of availability or otherwise.

13.Comic Relief and/or the BBC’s announcement as to who the winner is, is final. No correspondence relating to the prize draw will be entered into. The prize is as stated. There is no cash alternative and the prize is not transferable.

14. The winner agrees to take part in any reasonable post-prize draw publicity with Comic Relief and the BBC, if required.

15. Comic Relief must publish that a valid award took place. To comply with this requirement, Comic Relief will publish the surname and county of the winner and, if applicable, their winning entry on the Comic Relief website on 3 April 2023.The BBC will also publish information on the winner on its website on 3 April 2023 in order to comply with its legal and regulatory obligations. Comic Relief, the BBC and their sub-contractors, subsidiaries and/or agencies (including Fonix Mobile PLC (Fonix) and Upward Communications (Upward Comms)) cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider or otherwise which may result in any text not being properly received, nor for any lost, delayed, inaccurate or incomplete post, postage due, misdirection or strike action which may result in any postal entries not being received by the applicable closing date.

If you are randomly selected as the winner, Fonix will share your information with Comic Relief and the BBC in order for Comic Relief and/or the BBC to contact you to let you know you have won and to administer the prize. Any additional information provided as part of the Gift Aid declaration will only be used for the purpose of Comic Relief’s legitimate interests of claiming Gift Aid and in order to help analyse our income. The BBC will receive the winner’s name and contact details in order to announce the winner on BBC Radio 2 (on a date to be agreed with the winner) and publish information on the winner on its website. The BBC relies on its legitimate interests in increasing its audience engagement with broadcast prize draws, to provide interesting on-air content and assisting with fundraising for its charity partners, such as Comic Relief. The BBC doesn’t believe this unreasonably impacts on your rights and freedoms. The BBC will also keep the winner’s details on file for two years after the prize draw in order to comply with its legal and regulatory requirements as broadcast promoter. Entrants must have a public profile in order for their entry to be visible. Proof of age, identity and eligibility may be requested.

  5. There is no entry fee to enter the prize draw. You may only enter the prize draw once on Instagram and/or Facebook. In the event of multiple entries being received from the same Instagram or Facebook account, the first entry only will be accepted.

  6. There is only ONE prize available to be won:

    1. 2x Gold Circle tickets to American Express BST Hyde Park - Take That concert on Sat 1 July 2023.

    2. £200 towards your reasonable travel cost. Travel must be within UK, Channel Islands and Isle of Man.

- Insurance:  Comic Relief will contribute insurance costs up to £500 or arrange for insurance at our discretion with a selected provider. Any premiums above this amount requires the balance to be paid by the winner. The insurance cover available to the winner will be subject to the insurance provider’s policy underwriting guidelines.

- Warranty: The winner will be provided with a warranty for the car which may include roadside recovery and assistance, and a single claim maximum limit of £1,000 for 12 months from the date on which the winner is registered as the owner.

- MOT: The car will be provided with an MOT valid for 12 months.

- Road Tax: Road tax for the car will be paid for a period of 12 months from the date on which the winner is registered as the keeper on the logbook.

10. The winner will be selected using an independent randomised draw system on 13 April 2023 and contacted to notify them of their win. Comic Relief will attempt to contact the winner between 09:00 and 19:00 that day by phone. If the winner does not answer after Comic Relief’s reasonable attempts to contact them (meaning 4 calls per day at various times of the day over two days) Comic Relief will move on to contact the next randomly selected winner.

There is no cash alternative. If a winner wishes to give the prize to another person as a gift, express prior consent must be obtained from Comic Relief.

13. The winner agrees to take part in any reasonable post-prize draw publicity with Comic Relief and the BBC, if required.

14. Comic Relief must publish that a valid award took place. To comply with this requirement, Comic Relief will publish the surname and county of the winner and, if applicable, their winning entry on the Comic Relief website on 21 April 2023.The BBC will also publish information on the winner on its website on 21 April 2023 in order to comply with its legal and regulatory obligations.

If you object to any or all of your surname, county and winning entry being published or made available, please contact Comic Relief by emailing. For the avoidance of doubt, Comic Relief must still provide the information and winning entry to the Advertising Standards Authority on their request.

15. The prize is subject to change. Descriptions of the prize are provided without a warranty or representation of any kind. In no event shall Comic Relief, the BBC or any prize provider be liable for any claim demand or damages caused to an entrant by reason of a description of the prize being inaccurate, incomplete, or for the prize being otherwise in any way different to the entrant’s expectations.

Comic Relief reserves the right to disqualify any entries that breach these rules or are in any way fraudulent. Comic Relief reserves the right to cancel the prize draw at any stage, if deemed necessary in its opinion, or if circumstances arise outside its control.

Unless otherwise notified, the car will not be delivered to the winner and they are responsible for collecting it themselves; If the winner is responsible for collecting the car, Comic Relief will contribute up to £500 of the winner’s reasonable travel costs associated with collecting the car. If the winner is unable to collect the car, they will need to arrange for it to be collected on their behalf and Comic Relief will contribute up to £500of the winners reasonable cost associated with collecting the car. Unless otherwise stated in these terms, the winner will be responsible for any and all costs associated with registering or owning the car.

16. Comic Relief, the BBC and their sub-contractors, subsidiaries and/or agencies (including Fonix Mobile PLC (Fonix) and Upward Communications (Upward Comms)) cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider or otherwise which may result in any text not being properly received, nor for any lost, delayed, inaccurate or incomplete post, postage due, misdirection or strike action which may result in any postal entries not being received by the applicable closing date.

If you enter by text, your information (mobile phone number and amount of donation) will be collected by Fonix Mobile PLC on behalf of Comic Relief and will only be used to process your donation, provide receipts, manage any refunds and failed donations as necessary.  If you are randomly selected as the winner, Fonix will share your information with Comic Relief and the BBC in order for Comic Relief and/or the BBC to contact you to let you know you have won and to administer the prize. Any additional information provided as part of the Gift Aid declaration will only be used for the purpose of Comic Relief’s legitimate interests of claiming Gift Aid and in order to help analyse our income. Comic Relief’s lawful basis for this processing is that it is in Comic Relief’s legitimate interests (and we don’t believe this unreasonably impacts on your rights or freedoms). The BBC doesn’t believe this unreasonably impacts on your rights and freedoms.
